The defence rested its case on 26 June at the end of the testimony of its 34th witness whereas the prosecution had rested its case on 22 April after having called 20 witnesses.
Indicted for crimes of genocide, crimes against humanity and war crimes, Setako, who has pleaded not guilty, was the Director of Legal Affairs at the ministry of defence in 1994.
A graduate of the National Military School (ESM) in Kigali, Setako is facing charges of crimes committed in Kigali and in his native prefecture of Ruhengeri, northern Rwanda.
The prosecutor has alleged that the defendant took part in the night of 6 April 1994 in a preparatory meeting for the massacres in the Ruhengeri commune.
Setako was arrested in a center for asylum seekers in The Netherlands in February 2004. His trial began on 25 August 2008.
The Chamber is presided by a former ICTR president, Norwegian Judge Erik Mose, who will leave the Tribunal after the judgement of the case.
